This website and the services offered through this website (collectively, this “Site“) are operated and maintianed by Blue Cross Blue Shield of Wyoming (“BCBSWY“). PLEASE READ THESE TERMS AND CONDITIONS CAREFULLY BEFORE USING THIS SITE.

Acceptance of Terms and Conditions

The following terms and conditions (“Terms“) govern your use of this Site. By accessing, viewing, or using the material on the Site, you indicate that you understand and accept these Terms. We may revise and update these Terms at any time. Please periodically review these Terms as posted on this Site, because your continued use of this Site after changes to these Terms have been posted will mean that you accept those changes.

BCBSWY is an independent corporation operating under a license from the Blue Cross and Blue Shield Association (the “Association“), which permits BCBSWY to use the Blue Cross and Blue Shield service marks in the State of Wyoming; (ii) BCBSWY is not contracting as the agent of the Association; (iii) you have not agreed to these Terms based upon representations by anyone other than BCBSWY, and that no person, entity or organization other than BCBSWY shall be held accountable or liable to you for any of BCBSWY’s obligations to you under these Terms.

No Solicitation or Offer

This Site is designed to provide general information about BCBSWY, its products, services, and plans. Information on the Site is not intended to constitute an offer to sell or a solicitation of any particular product or service. Some products and/or services may not be available for all employees, members, or in all areas of the State of Wyoming.

Privacy and Security

BCBSWY has a Privacy Statement disclosing what information we collect about visitors to this Site, how we use such information, the steps we take to secure such information, how you can view and correct such information, and how you can decline to have information about you collected or used. The Privacy Statement also discloses information about the security and confidentiality of information that you submit to us via e-mail or this Site. When you provide us with your email address or telephone number, we may communicate with you through (a) electronic delivery of communications about existing benefits, programs, products, services, or tools and/or general health information via email, websites, and mobile applications (collectively, “Informational Electronic Communications“) and (b) informational calls and text messaging (“Informational Calls and Texts“), regarding the programs, products, or services that we make available to you.

Informational Electronic Communications include, but are not limited to, information about your benefit plan, programs, products, or services that are or may be available to you in connection with your transactions with us, online services updates, general wellness reminders or information, general health information, newsletters, and surveys. They do not include communications we are required by law to provide to you in writing (“Required Notices“).

When you provide us a telephone number, whether landline or mobile, we may contact you, using automated, pre-recorded, or non-automated means, to provide you information about your existing benefits, programs, products, services, or tools. The Terms and Conditions of the texting programs we offer, as well as those programs’ specific requirements, apply to your interactions with us via text and are incorporated in these Terms by reference.

To opt out of Informational Electronic Communications and/or Informational Calls and Texts, please update your preferences on the Communications Preference page of the member portal. You can also call us to let us know you no longer wish to receive these communications. Any request to opt out of receiving these communications will be effective only after we have a reasonable period of time to process your request. Opt-outs may not apply to certain types of communications, such as Required Notices, account status, Online Services updates, or other plan communications.

You have the opportunity to update your contact information and choose your communication preferences at any time through the Communications Preference page of the member portal. It is your responsibility to provide us with accurate contact information, and to update any changes promptly. We may use the same contact information previously provided if you change or add a benefit plan, program, product or service that we make available to you. You understand that failing to update your contact information may delay providing you Informational Electronic Communications. You release and hold us harmless from any consequences of your failure to provide us accurate contact information or to update your contact information.

Users’ Privacy
You are required to provide your e-mail address when registering for access to the Site. BCBSWY may use this e-mail address to contact you with information about your account and access to the Site.

While Blue Cross Blue Shield of Wyoming is committed to protecting the privacy of its members and others, it is possible that any transmission of data on or through the Internet may be intercepted, monitored, or downloaded by an unauthorized third party.  Please be advised that the confidentiality of any communication or material transmitted to BCBSWY via this Site or electronic mail cannot be guaranteed, including without limitation personal information such as your name, address or Social Security number.  To the extent allowed by state and federal law, BCBSWY expressly disclaims any liability for any data transmitted by the user, intentionally or otherwise, over the Internet. The user assumes all risk for the sending of any information, by any means, intentional or otherwise, via the Internet. While we make every attempt to protect the personal information that you share with us, it is important to realize that electronic mail is not secure against interception. You should never send electronic mail to BCBSWY containing personally identifiable information.  Unless BCBSWY obtains your express consent, BCBSWY will not use electronic mail to communicate any such information to you. Never provide your password in an e-mail. The message center allows registered members to securely ask questions and receive answers to questions containing sensitive information, and this feature should be used instead of electronic mail.

Indemnification
You agree to indemnify, defend and hold harmless BCBSWY, its officers, directors, employees, agents, licensors, suppliers and any third-party information providers to the Site from and against losses, expenses, damages and costs, including reasonable attorneys’ fees, resulting from any violation of these Terms or any activity related to your account (including negligent or wrongful conduct) by you or any other person accessing the Site with your account.

Subscription agreement and/or benefit document controls
Nothing in this Site and any linked site, as well as any downloaded forms or documents, changes, alters, adds to or supersedes the terms and conditions of any health care benefits plan insured and/or administered by Blue Cross Blue Shield of Wyoming. In the event of a conflict or ambiguity between any statement in this Site or any linked site, as well as any downloaded forms or documents, and any subscription agreement or benefit document (as applicable), the terms and conditions of such subscription agreement or benefit document shall control.

Information may or may not be updated
Information on this Site may be changed, removed, or updated without notice. BCBSWY has no obligation to change, remove, or update any information presented on this Site, so information contained herein may be out-of-date at any given time. BCBSWY may also make improvements or changes in the products, services, networks, and programs described in this Site at any time, without notice.

Provider Network listings
BCBSWY maintains networks of medical service providers in an effort to help contain the cost of medical services and simplify health care cost financing for its subscribers. The listing of a provider in BCBSWY’s provider networks or any provider network accessed via link from this Site, shall not constitute an endorsement, guarantee, warranty, or other statement of quality, competency, or licensure status to provide any medical service or supply, and BCBSWY expressly disclaims any responsibility or liability, financial or otherwise, for the services rendered or supplies provided by any listed provider.

Information provided by BCBSWY on the Site is for general information purposes only and should not be interpreted as advice or counseling of any kind. Any use of these trademarks or service marks, without the prior written consent of BCBSWY and/or BCBSA, is expressly prohibited. All other trademarks and/or service marks used herein are the property of their respective owners.

Applicability of state and federal laws
All products, services, and information provided on this Site are provided subject to all applicable state and federal laws. This includes, but is not limited to, all laws related to insurance, employee benefits, equal employment opportunity, and the Americans with Disabilities Act.

Jurisdiction
Blue Cross Blue Shield of Wyoming holds an exclusive license from the Blue Cross and Blue Shield Association to use the “Blue” names, trademarks, and service marks in the state of Wyoming.  Pursuant to applicable laws and the terms of its license from the Blue Cross and Blue Shield Association, BCBSWY serves Wyoming residents and employers whose principal place of business is in Wyoming. BCBSWY is licensed to underwrite health coverage in the state of Wyoming only and does not engage in the business of insurance outside Wyoming except as may be permitted by law. Nothing contained in this Site shall constitute a solicitation, offer or acceptance of a contract of insurance or be construed as creating or modifying any agreement with BCBSWY. By accessing, transmitting or viewing any information on this Site, you agree to be subject to personal jurisdiction in the state of Wyoming. Any claim or dispute arising out of accessing, transmitting or viewing any information on this Site shall be venued in Laramie County, Wyoming, and governed by the laws of the state of Wyoming.

Termination
Either party may, at its election and in its sole discretion, terminate access to the Site. If you wish to cancel your access to the Site, you must notify our Member Services department. BCBSWY may, at any time, terminate your access to the Site without advance notice, due to, but not limited to, coverage cancellation, prolonged periods of inactivity or a violation of these Terms.

Modifications
BCBSWY may modify the Terms at any time and such modifications shall be effective immediately upon posting. You agree to review the Terms periodically and by continuing use of the Site, accept any modifications to the Terms.

SMS Terms and Conditions:

BCBSWY offers a service where you can receive relevant alerts via SMS text messaging (Program). The Program requires a mobile phone number to enroll and is on-going. Subscribers will be allowed to opt-out of this Program at any time. By subscribing to the Program you agree to the following Terms and Conditions.

Receiving SMS Text Messages

You are receiving SMS text messages because you consented to receiving SMS text messages during the course of your interaction with BCBSWY or because you texted a promotional keyword to the short code 222799.

User Fees:

BCBSWY offers the convenience of relevant, up-to-date alerts, and information regarding BCBSWY at no charge. Message and data rates from your carrier may apply. By providing your consent to participate in this Program, you acknowledge that any such charges from your mobile carrier are your responsibility. Charges for SMS text messages may appear on your mobile phone bill or be deducted from your prepaid balance. You are responsible for managing the types of SMS text messages you receive.

How to Opt-Out of SMS Text Messages

When you receive a SMS text message, reply STOP to 222799 to stop receiving SMS text messages. We will send you a final text message confirming that you will no longer receive SMS text messages unless you opt-in again.

How to Opt-In of SMS Text Messages

Text Enroll to 222799 to receive relevant up-to-date alerts and information regarding BCBSWY. Message frequency varies and may be reoccurring and ongoing. Message and data rates may apply.

How to Receive Help or Support

For help regarding SMS text messages, reply HELP to 222799 for help at any time. You can also call 800-442-2376 at any time to speak to someone for additional information or support regarding BCBSWY or any type of communication.

Access and Delivery is Not Guaranteed

BCBSWY is not liable for any delayed or undelivered SMS text messages in connection with the Program. Delivery of SMS text messages is subject to effective transmission from your carrier. The information in any message may be subject to certain time lags and/or delays. BCBSWY reserves the right to terminate your participation in the Program, in whole or in part, at any time without notice.

BCBSWY Services are Not Conditional

Consent to receive SMS text messages is not required as a condition to receiving or purchasing any services from BCBSWY. SMS text messages may be sent via an automatic telephone dialing system.
